(“WAWCS”)

TERMS AND CONDITIONS
AND
CODE OF CONDUCT

 

1. Definitions:

“Commencement Date” means the 20th April & 8th September 2018.

“Company” means Pedal and Putt Limited trading as Ride Wild.

“Completion Date” means the 8th May and 26th September 2018.

“Event” means Wild Atlantic Way Cycle Sportif (“WAWCS”).

“Fee” means the registration fee that You are required to pay to confirm Your place in the Event, which is Forty-Five Euros (€85.00) per single day participation (without overnight accommodation includes luggage transfer facilities) and Ninety Euros (€695)  for multiple day participation (with overnight accommodation, all meals, luggage transfer facilities) HOWSOEVER ***.

“Minimum Age” means at least 18 years of age at the Commencement Date of the Event.

“You/Your/Yourself” means the person agreeing to be bound by these Terms and Conditions and Code of Conduct and who is participating in the Event organised and/or run by Pedal and Putt Limited.

“Pedal and Putt Limited” means Pedal and Putt Limited (Company No. 583718) having it’s registered office at No. 43, Blackmill Street, Kilkenny, in the County of Kilkenny, in the Republic of Ireland, Company Limited by Shares, trading as Ride Wild, which is organising the Event.

“Privacy Policy” means the Privacy Policy of the Company.

“Registration Form” means the Registration Form completed or to be completed by You to apply to book Your participation in the Event.

“Ride Wild” means the Company which trades as Ride Wild.

“Terms and Conditions” means these Terms and Conditions and Code of Conduct.

 

 

2. Participation

You ACKNOWLEDGE AND/OR AGREE AND/OR ACCEPT as follows:-

    1. that participation in the Event may be physically demanding and You are aware of the nature of the Event and the associated medical and physical risks involved;
    2. that you are physically capable of taking part in the Event;
    3. that You will be solely responsible for your actions from the commencement date to the completion date and save as provided elsewhere in these Terms and Conditions;
    4. that the Company is not responsible for any injury or illness that You may suffer as a result of Your participation in the Event;
    5. that should any medical or physical condition arise prior to the Commence Date, which is likely to affect Your ability to participate in the Event that You will notify the Company immediately thereof;
    6. that in the event that the Company receives Your notification as set out in paragraph e. above the Company in its sole absolute discretion can exclude You from the Event SUBJECT in that event that Your notification is received by the Company more than thirty (30) days prior to the Commencement Date to a Refund of the Fee less the sum of Fifty Euros (€50.00) to cover administration expenses HOWSOEVER that in the event that Your notification is received within thirty (30) days of the Commencement Date you will not be entitled to a refund of the Fee or any part thereof;
    7. that You have read these Terms and Conditions in advance of the completion by you of the Registration Form and that you hold yourself thereby;
    8. that you will Comply with any further rule(s) and/or regulation(s) made by the Company in respect of the Event as the Company or its agent may notify to You from time to time.
    9. Entries into the 2018 event are personal to the applicant. They cannot be sold or transferred. Any transferred entry will be void.

 

 

3. Bookings, Payments and Your obligations

You ACKNOWLEDGE AND/OR AGREE as follows:-

    1. that You will accurately complete the Registration Form for the Event and submit it to the Company as advised;
    2. that You will immediately make payment to the Company of the correct Fee in accordance with Your Registration Form and by any of the methods as advised;
    3. that You shall not be eligible or entitled to participate in the Event until the Company or its agent has provided You with written confirmation that Your registration was successful and full payment of the Fee has been received by the Company or its agent;
    4. that You Will follow each and all instruction(s) given to You during the Event by the Company and/or any agent(s), employee(s) or other official(s) of the Event.
    5. that completion by You of the Registration Form and payment by You of the Fee has an immediate effect on the logistics of the Event and the expenditure of the Company in the organisation of the Event and accordingly You may only withdraw from the Event where:-
      1. due to serious injury, serious ill health or any other serious personal reason(s) You are left with no option but to withdraw from the Event and you notify the Company more than thirty days (30) prior to the Commencement Date (SUBJECT as set out herein); or
      2. You withdraw from the Event and notify the Company not less than thirty (30) days prior to the Commencement Date of your withdrawal and request the Company to roll Your registration over to the following year PROVIDED a similar event takes place and such roll over is possible in all the circumstances, in which event you shall only be entitled to roll over your registration and the Fee once and this is at the discretion of the Company.
    6. That notice of withdrawal from the Event must be communicated by emailing info@ridewild.ie, or by writing to the Company at its registered office.
    7. that Your Registration in the Event and the Fee paid by You is personal to You and You may not transfer either, or other right(s) or obligation(s) arising therefrom (if any), to any other person or body in any circumstances or at any time;
    8. that the Company may refuse entry to, remove or exclude or cancel Your registration in the Event if:-
      1. it is considered by the Company or it’s agent(s) that you are (due to physical or health reason(s) or otherwise) incapable of participating in the Event without endangering Yourself or others;
      2. It is considered by the Company or its agent(s) that your participation in the Event will bring the Event, or Company into disrepute or otherwise damage the reputation of the Company or the Event.

 

4. Withdrawal, Cancellations or Alterations

    1. The Fee is non-refundable save and except as set out herein or in the event that the Company in its sole discretion decides to refund the Fee in whole or in part in limited circumstances such as and by way of example only:-
      1. That the Event is cancelled through no fault of the Company.
      2. That You are unable to participate in the Event for reasons beyond Your reasonable control.

 

5. Publicity and Results

    1. By taking part in the event you agree that the Company reserves the exclusive right throughout the world (and You HEREBY IRREVOCABLY GRANT to the Company such exclusive right (at no cost)) to interview, and/or photograph, and/or film You at the Event and/or before and/or after the Event as the Company may reasonably require in its sole discretion in connection with the Event to use, reproduce or resell any photos, videos or recordings of You which are taken during the Event for any purpose(s) related to the Event or the promotion of any future similar event(s) , and the Company may use any and all material produced as a result of this right as it may decide in its sole absolute discretion, and You HEREBY CONSENT thereto.

 

      1. You agree that the Company own all rights (including all intellectual property rights) in any material produced by the Company or on its behalf (without incurring any costs to You) and You shall obtain no rights in relation to the same.

 

6. Loss or Damage suffered by You
You ACKNOWLEDGE AND AGREE that You are taking part in the Event at Your own risk.

Liability – To the extent permitted by law, neither Pedal and Putt Limited nor its sponsors or suppliers will be liable for any loss, damage, illness or injury whatsoever directly or indirectly occasioned by or resulting from the negligence, wrongful act or default of Pedal and Putt Limited, its sponsors and suppliers or their respective servants or agents or from any other cause, including any act of God or the physical condition of the cyclists

 

7. Conduct During Event
You ACKNOWLEDGE AND AGREE as follows:-

    1. that at all times during your participation in the Event You are responsible for Your own safety on the road and that You will at all times obey all traffic regulations as enforced by local authorities during the Event and that You will at all times during the Event adhere to the Rules of the Road (available @ http://www.rsa.ie) and that You are aware that the Event in being held on open public roads with differing level of traffic at all times.
    2. that You will at all times during the cycling phases of the Event wear proper protective clothing (including but not limited to the wearing of proper protective headgear).
    3. that You will at all times during your participation in the Event wear the WAWCS cycling gear provided by the Company.
    4. that You will at all times during the Event ensure that Your bike and any other cycling equipment is in good roadworthy condition.
    5. that You will at all times during the Event cycle in an appropriate and safe manner having regard to road traffic and weather conditions and that You will slow down, give way or stop where and when necessary in the interests of courtesy, safety or obligation.
    6. that You will at all times during the Event avoid confrontation with other road users and/or pedestrians,
    7. that You will at all times during the Event act responsibly to promote the good image of the Event and cyclists generally.
    8. that you will at all times during the Event respect the property ownership and property rights of the owners/occupiers of all properties adjoining the Event route and in particular that you will not trespass upon such properties for any purpose.
    9. that at all times during the Event You will not behave or conduct Yourself in any manner which may cause offence to or be a nuisance to any other participant(s) in the Event or to any member of the public in general and that You will refrain from harassing any individual and that You will not engage in any unwelcome visual, verbal or physical conduct towards any other person.
    10. that at all times during the Event You will respect the rights and dignity of each and every other participant in the Event, individually and collectively, regardless of their gender, age, marital status, religion, ethnic background, colour, disability or political persuasion and that You acknowledge that each and every such other participant (individually and collectively) has the right to participate in the Event without fear of harassment, bullying or intimidation and in a safe manner.
    11. That you will report any grievance or complaint of any nature or kind, which you may have, to the Company or its agent(s) at the earliest opportunity.
    12. that at all times during the Event You will respect the rights and dignity of each and every official, volunteer connected in any way with the Event, individually and collectively, regardless of their gender, age, marital status,, religion, ethnic background, colour, disability or political persuasion and that You acknowledge that each and every such person participant (individually and collectively) has the right to participate whatever way in the Event without fear of harassment, bullying or intimidation and in a safe manner.
    13. that at all times during the Event You will avoid the use of abusive language of any nature or kind and that You will refrain from making inflammatory or disparaging remarks verbally or on any website(s), social media outlets or otherwise about any other participant in the Event or about any other member of the general public, which may cause offence to any other participant(s) in the Event.
    14. that at all times during the Event or at any time thereafter You will refrain from taking, manufacturing, showing, posting or exhibiting (or threatening to do any of the foregoing) any image which is pornographic in nature or which contains nudity or gratuitous violence, and which is in any way, or which can in any way be, linked to or identified with the Event.   
    15. that al all times during the Event You will uphold the good name and reputation of the Event, the Company and the sponsors of the Event.
    16. that at all times during the Event you will practice good sportsmanship towards all other participants in the Event.

 

Data Protection

You ACKNOWLEDGE AND AGREE that:-

  1. by participating in the Event any personal information provided by You or collected about You in connection with the Event may be held and used by the Company in relation to the Event and it’s promotion;
  2. that the personal information provided by You may be shared by the Company with:-
        1. any and all essential third parties in connection with the logistics and organisation of the Event, who in turn may use it in connection with the organisation and/or administration of the Event or for other reasons associated with the Event; and
        2. with the media for reporting on the Event.
        3. to inform the Company of any changes to the information supplied by You in Your original Registration Application as soon as such changes occur;
        4. that the Company will be the data controller of the information which You provide or which the Company obtains in relation about You in connection with or in relation to the Event.

NOTE:  The Company will take all steps reasonable steps necessary to ensure that Your data is treated securely and in accordance with its Privacy Policy (which can be found at https://www.wildatlanticwaycyclesportif/privacy policy)].

 

GOVERNING LAW

These Terms and Conditions and Code of Conduct shall in all respects be governed by and construed in accordance with the Laws of the Republic of Ireland and You HEREBY AGREE that the Courts of the Republic of Ireland have exclusive jurisdiction to hear and determine any disputes arising out of or in connection with these Terms and Conditions and Code of Conduct and in connection with the Event generally.

If any provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.  If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
